Terms of Service

These Terms are an agreement between you and VoiceSmiths ("the Service"), operated independently by an individual developer. By creating an account or using any feature, you accept them.

1. The Service

VoiceSmiths provides AI speech tools: text to speech, voice cloning and voice design, multi-speaker dialogue, video dubbing, speech to text, sound effects, and a real-time voice agent. Features may change between releases.

2. Accounts

• Register with a valid email address; you are responsible for everything done under your account.
• Keep your password secure. Losses caused by your own failure to do so are yours to bear.
• One account per person. Using multiple accounts, scripts or other technical means to claim free quota repeatedly may result in the quota being revoked and the account suspended.

3. Credits and billing

• The Service is metered in credits. Speech synthesis is charged per character, at rates that differ by model; other features are charged per run. The price shown on the button at the moment you generate is the price that applies.
• Failed generations are refunded in full, automatically.
• Subscription credits are a per-period allowance. They are granted each billing cycle and expire at the end of that cycle. They do not roll over.
• One-time credit packs do not expire until used.
• Credits are a usage allowance. They cannot be withdrawn, transferred or exchanged for cash.
• Prices may change. Changes apply only to new orders and new billing cycles, never retroactively.

4. Voice cloning and consent — read this

This is the most important restriction on the Service. To use voice cloning you must meet all of the following:

1. The voice is your own, or you hold explicit, documented permission from the person whose voice it is;
2. You must not clone or imitate the voice of a public figure, performer, broadcaster, deceased person, or any third party who has not consented;
3. You must not generate speech intended to impersonate a specific real person;
4. You must not use output to falsify identity, commit fraud, fabricate evidence, defeat voice authentication, or produce any infringing deepfake.

The "character voices" we provide are AI-designed originals, not clones of any real person, and may be used commercially subject to these Terms.

Breaching this section may result in immediate content removal and account termination without refund. You are responsible for any resulting legal liability, and will indemnify us against losses or third-party claims arising from your use.

5. Prohibited uses

You may not use the Service to create or distribute:

• Content that violates applicable law or endangers national security or public order;
• Obscene, violent, terrorist, gambling or drug-related content;
• Content that defames, harasses, or infringes another person's reputation, likeness, voice or privacy rights;
• Content that infringes copyright, trademark or other intellectual property;
• Content used for fraud, harassment, intimidation or disinformation;
• Content that is harmful to minors.

We may remove content and suspend or terminate accounts without prior notice upon report or discovery of a breach.

6. Ownership

• Your uploads remain yours. You grant us the permissions needed to operate the Service, including transmitting content to third-party providers for processing. That permission ends when you delete the content.
• Audio you generate is yours and may be used commercially, provided you comply with these Terms — section 4 in particular.
• You are responsible for ensuring your uploads do not infringe anyone's rights.

7. Refunds

• If a technical fault on our side prevents use and we cannot fix it within a reasonable time, you may request a refund;
• Credits already consumed are not refundable;
• You may cancel a subscription at any time. Access continues to the end of the period you have paid for; that period is not pro-rated or refunded;

8. Changes and interruptions

The Service may be suspended for maintenance, upgrades, third-party provider failure or force majeure. We will give notice where we can, but we are not liable for losses caused by interruption. Unconsumed credits affected by a prolonged outage may be extended or refunded on request.

The Service depends on third-party AI providers. If those providers change their terms, raise prices or withdraw service, we may adjust features or pricing accordingly.

9. Disclaimers and limitation of liability

• The Service is provided "as is". We do not warrant that output will meet your expectations, or that the Service will be uninterrupted or error-free;
• AI output may contain mispronunciations or errors — verify it before publishing;
• To the maximum extent permitted by law, our total aggregate liability is limited to the fees you actually paid in the preceding 12 months;
• We are not liable for indirect, incidental or consequential loss, lost profits, lost data or reputational harm.

Nothing here excludes liability that cannot lawfully be excluded.

10. Changes to these Terms

We may revise these Terms. Material changes will be announced in the product or by email. Continued use after a change means acceptance. If you do not accept, stop using the Service and you may close your account.

11. Governing law

These Terms are governed by the laws of the People's Republic of China. Disputes should first be settled by negotiation; failing that, either party may bring proceedings before a competent court at the operator's place of residence.
